Welcome to Dark Reader. These Terms of Service (“Terms”) govern your use of the Dark Reader website at dark-shiftmode.com (the “Website”), the online tools on it, and the Dark Theme for Chrome extension (the “Extension”). We call them collectively the “Service”. The Service is operated by our team (“we,” “us,” or “our”).

By visiting the Website, installing the Extension or otherwise using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use our Service.

Use of the tools

The Website offers free browser tools for reading, writing and working on a dark screen, such as a PDF reader, EPUB reader, text reader, notepad, focus timer, image colour tool, contrast checker, spreadsheet and Word viewers, and a screenshot tool. No account is needed. The tools are meant for personal and everyday use, and you agree to use them in compliance with these Terms and applicable laws.

Your files and content

You keep all rights to the files, text and images you open or create with the tools. We do not claim ownership of them and, as described in our Privacy Policy, the tools process them on your device rather than on our servers.

You are responsible for your content: you confirm that you have the right to open and process the files you use, and that you will not use the tools for anything unlawful or in a way that infringes the rights of others.

My Library and local storage

My Library and some tools save data in your browser’s storage on your device. We do not keep a copy. Clearing site data, switching browsers or devices, using a private window, or a browser or storage limit can remove saved files, notes and settings, and we cannot restore them. You are responsible for keeping your own backups, for example with the Download option in My Library.

Accuracy of results

The tools are provided for convenience. Files can look different from the original after a dark tone or other change is applied, and some formats or features may not display perfectly. The Contrast Checker and Image Color results are guidance only and are not a certification of accessibility or legal compliance. Keep your original files, and do not rely on the Service for critical, legal, medical or financial decisions.

Acceptable use of the Website

In addition to the rules for the Extension below, you agree not to:

• Try to disrupt, overload or gain unauthorized access to the Website or its infrastructure
• Copy, scrape or mirror the Website at scale, or present it as your own or as associated with you
• Use the tools to process content that is illegal or that you have no right to use

Changes and availability

We may add, change or remove tools and features, or suspend the Website, at any time and without notice. We do not promise that any particular tool will always be available.

Third-party services and links

The Website uses services provided by others, including Google Analytics, Cloudflare and Google Fonts, and links to third-party sites such as the Chrome Web Store and Microsoft Edge Add-ons. These are governed by their own terms and policies. See our Privacy Policy for how they are used.

Use of Service

Our Extension is designed to provide a dark theme for websites you visit. You agree to use the Service only for its intended purposes and in compliance with these Terms and any applicable laws and regulations.

You agree not to:

• Modify, adapt, or hack the Service or modify another website to falsely imply it is associated with the Service
• Attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising the Service
• Use the Service in any way that could damage, disable, overburden, or impair the Service
• Use any robot, spider, crawler, scraper, or other automated means to access the Service

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of our team and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of our team.

Open-source libraries used on the Website remain the property of their authors and are used under their own licenses.

Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable

Limitation of Liability

In no event shall we, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, files, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Loss or deletion of files, notes or settings stored in your browser

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.
